Current Scope of Practice

David Brewster focuses his practice primarily in the areas of business, commercial and general civil litigation, as well as business transactions.  Formerly of Sedgwick, Detert, Moran & Arnold LLP, an American Lawyer Top 150, international litigation firm, he currently represents clients in matters arising from contractual and various other business transactional relationships, as well as litigation matters including commercial and business disputes and injury involving bodily injury and non-bodily injury, such as property boundary disputes, and other injuries to personal property.  Mr. Brewster also has experience in the automotive industry, representing auto dealers in both litigation and purchase and sale transactions.  Additionally, Mr. Brewster has substantial experience in litigating disputes between borrowers and mortgage lenders in both State and Federal Court.   

Representative Matters

Most recently, Mr. Brewster obtained a defense jury verdict against a plaintiff seeking more than $250,000 in damages for breach of contract and fraud related to a consulting agreement.  In addition to the full defense of the Plaintiff’s claims, Mr. Brewster also obtained a large attorney’s fees settlement from the plaintiff for his client.  Mr. Brewster has also obtained and an award of over $500,000 in attorney’s fees and costs in favor of an international franchisor against claims brought by one of its licensee’s franchisees claiming fraud, negligent misrepresentation, breach of contract and violations of the California Franchise Investment Law.  His other victories at trial also include a matter where he obtained a judgment in excess of $100,000 on behalf of a sub-contractor against a developer for non-payment of contract monies due, where the developer had cross-claimed against Mr. Brewster’s client for over $700,000 in damages.  Mr. Brewster also achieved a major defense victory by limiting the verdict to $97,000 in a case where a food manufacturer had abandoned the manufacturing facility with over two years remaining on the commercial lease for the building and as a result, had been sued for over $1,000,000 in damages under the commercial real estate lease and for alleged physical damage to the property.

No stranger to business transaction, Mr. Brewster has assisted clients with several asset purchase and acquisition matters.  He has experience in transactional deals ranging from $50,000 to $18,000,000.00, including the negotiation of deal terms and the drafting of deal agreements and supporting documents.

Mr. Brewster has handled several matters as defense counsel for major insurers, including AIG, Fireman’s Fund, The Hartford, Westchester and Zurich.  While acting as coverage counsel for major insurers such as State Farm, Fireman’s Fund, TIG, Travelers and Lloyd’s of London, Mr. Brewster has provided numerous coverage opinions on claims in almost all areas of insurance, including Auto, Fire, Earthquake, General Liability, Garage Liability, and Directors and Officer’s liability.  Mr. Brewster has also assisted carriers with the drafting of policy language and by performing insurance claim audits, most notably, for Lloyd’s of London syndicates.

Affiliations, Activities and Accomplishments

Mr. Brewster is admitted to the California Bar (1997).  He is admitted to the U. S. District Court for the State of California, Southern, Central and Eastern Divisions.  He is also member of the Order of Barristers.


Mr. Brewster earned his B.A (1992) in Sociology from the University of California, Davis.  He earned his J.D. (1997) from the University of San Diego School of Law.  Upon graduation from law school, he was awarded the Dean's Award for Distinguished Service and the Statue of Justice Award for Excellence in Oral Advocacy.   Mr. Brewster also served as the Chair of the Appellate Moot Court Board while in law school and was a member of the Jessup International Moot Court Competition team.  Mr. Brewster was also awarded membership into the Order of Barristers.
